EQUINE SPORTS MASSAGE AND REHABILITATION COURSE

The Institute of Complementary Animal Therapies® (hereinafter called the "Provider") do offer to provide the ICAT® Equine Sports Massage And Rehabilitation Course (as described in the Booking Form) to the Customer on the following terms.

DEFINITIONS

"Course" means the Equine Sports Massage And Rehabilitation Course© provided by the Provider to the Customer at the Venue, in return for the Course Fee;
"Course Date" means ......
"Course Fee" means the total sum of £--- payable by the Customer to the Provider;
"Deposit" means the deposit in the sum of £300;
"Horse" means the Horse/s being used for the purpose of the Course; or the Customer's own Horse.
"Venue" means the .....

1. THE COURSE
1.1 The Provider will use reasonable skill and care in the provision of the Course.

1.2 The Provider will supply the necessary Horses (if the candidate wishes to bring their own Horse, please contact ICAT)

1.3 The Provider does not make any commitment to the Customer that the content of the Course will meet any specific requirements that the Customer may have. The Provider expects the Customer to take reasonable steps to verify that the course will meet their requirements and the needs of their Horse. Customers are required to familiarise themselves with the Veterinary Surgeons Act 1966 and gain prior approval from their Veterinarian before any massage treatments are carried out on their own, or other peoples Horse's for the purpose of case studies.

1.4 The Provider reserves the right to refuse to provide the Course, and/or allow the Horse entry to the Venue, if the Horse becomes unmanageable, in any way, including (but not limited to) situations when the Horse becomes aggressive or unruly, or if the Horse is not sufficiently healthy to undergo a massage treatment.

1.5 When bringing their own Horse, the Customer shall supply suitable control halters and lead ropes when necessary, tack and any rugs or blankets or other accessories which the Customer wishes to be used. The Customer will liaise with the Venue stable manager regarding suitable feeding and exercise times and appropriate BHS stable management in the provision of health care of the Horse during the course.

1.6 When bringing their own Horse, the Customer shall be responsible for the Horse at all times and will feed and water the Horse during the Course, or liaise with the stable manager regarding livery services. The Customer will also be responsible for ensuring that the Horse is sufficiently healthy for the Course to be undertaken, in particular that the Horse does not have, for example, any open wounds, skin conditions or any contagious condition.

1.7 The Customer shall inform the Provider fully of any characteristics of the Horse which need to be known for handling and care of the Horse during the Course.

1.8 The Provider will supply the Customer with light refreshments during coffee and afternoon tea breaks, the cost of which are included in the Course Fee. Lunch is not provided or included in the Course Fee.

1.9 The Course will commence at .... At the Venue and will finish at ......

2. PAYMENT
2.1 The Customer shall pay the Deposit of £300 to the Provider to secure their place on the Course, which shall be submitted with this completed and signed Booking Form. The Deposit is non-refundable in the event that the Course is cancelled by the Customer in accordance with Clause 3.2.

2.2 The remaining sum of the Course Fee (the balance) of £-- is payable by the Customer to the Provider no later than 28 days prior to the Course Date.

2.3 All Course Fees are payable to "ICAT."

3. CANCELLATION
3.1 The Provider may cancel the Course at any time up to 2 days prior to the Course Date. If the Provider cancels the Course, then all Course Fees paid by the Customer will be refunded to them or an alternative course offered.

3.2 The Customer may cancel the Course up to 28 days prior to the Course Date. If the Customer cancels the Course, then the Deposit paid will not be refunded, however the remaining Course Fee will not become due. Cancelling with less than 28 days notice requires the full course fee to be paid to the provider.

3.3 If a Course is cancelled, an alternative Course Date may be offered to the Customer at the absolute discretion of the Provider.

3.4 If the Customer books the Course and does not cancel the Course, but in any event does not attend the Course, or leaves part way through, then the full Course Fee will be payable by the Customer to the Provider within 7 days of the Course Date.

4. LIABILITY
4.1 The Provider shall have no liability to the Customer for any claim in respect of the Horse.

4.2 The Customer undertakes the Course using the Horse's provided (or their own Horse) at their own risk.

4.3 The Provider will have no liability or responsibility for any accidents or injuries which may occur during the Course and/or whilst at the Venue.

4.4 The Provider shall not be responsible to the Customer in the event that the Course cannot be provided due to an event beyond the Provider's reasonable control, which include (but is not limited to) events such as provider illness, fire, flood, storm, strikes or other industrial action, failure of telecommunication services, war, riot or the actions of any government or public body. In the event that the Provider is prevented from running the Course by such an event, the Provider will take reasonable steps to try to provide the Course to the Customer as soon as is reasonably practicable.

4.5 The Provider makes no representations or warranties, express or implied, as to the accuracy or effectiveness of the Course and the Customer acknowledges this.

4.6 The Provider shall have no liability whatsoever with respect to the appropriateness or reliance upon the Course by the Customer.

4.7 Whilst every effort is made to help and improve the wellbeing of the Horse, the Provider shall have no liability for any accident or illness arising from the massage treatment conducted on the Horse, both during or following the Course. Customers will at all times abide by the ICAT Health & Safety terms as stated in the ICAT Health & Safety Policy Booklet.

5. GENERAL PROVISIONS

5.1 This Booking Form contains all the terms agreed between the parties except for such variations as shall be agreed in writing by the parties.

5.2 The Booking Form shall be governed and construed in accordance with the laws of England and Wales and the parties consent to the exclusive jurisdiction of the English Courts.
